1.    Introduction:

            Nepal Telecommunications Authority was established in March 4, 1998 as an autonomous regulatory body within the framework of the Telecommunication Act 1997 A.D. and Telecommunication Regulation 1997 A.D.

As per the section 13 of the Telecommunications Act 2053 B.S. (1997 A.D.) the functions and duties of the Authority are as follows:

(a) To provide suggestions to Government of Nepal on the policy, plan and program to be adopted by Government of Nepal for the development of the Telecommunications Service.
(b) To make the Telecommunications Service reliable and easily available to the public.
(c) To make necessary arrangement to avail basic Telecommunications Service and facilities in all rural and urban areas throughout Nepal.
(d) To involve the national and foreign private sector investors in the operation of the Telecommunications Service.
(e) To make arrangement for the coordination and healthy competition among the persons providing Telecommunications Service and facilities, so as to provide such service and facilities to all public in general.
(f) To prescribe, fix and approve the standard and quality standard of the plant and equipment relating to the Telecommunications and the Telecommunications Service.
(g) To regularize and systematize Telecommunications Service
(h) To grant License to operate the Telecommunications service.
(i)  To approve and regularize the fees to be collected by a person having obtained License for providing the Telecommunications Service.
(j) To perform the functions relating to the frequency in accordance with the policy determined by the Radio Frequency Policy Determination Committee.
(k) To carry out or cause to carry out the research about the development and use of new technology in the field of Telecommunications.
(l) To cause to develop the skilled manpower for the Telecommunications Sector.
(m) To develop and extend or cause to develop and extended the Telecommunications Service in such a way that it protects the rights and interests of the consumers.
(n) To develop or cause to develops Nepal as an International Transit for Telecommunications.
(o) To carry out necessary and appropriate functions for the development and promotion of the Telecommunications Service.

2.    NTA activities during the month of Falgun 2064 (13 February 2008 - 13 March, 2008):

2.1.            Mr. Ambar Sthapit, Deputy Director, NTA completed an online training on  "Spectrum Management" held from 21 January to 29 February, 2008 in coordination with International Telecommunication Union (ITU) and Center of Excellence, Iran.
2.2.            Assistant Directors of NTA Mr. Surendra Lal Hada and Mr. Udaya Raj Regmi completed an online training on "Mobile Number Portability" held from 21 January to 29 February, 2008 in coordination with International Telecommunication Union (ITU) and Pakistan Telecommunications Authority.
2.3.            Press Meet was organized on 19th of Falgun 2064 (date in AD) on the occasion of tenth anniversary of NTA. 
2.4.            Provisional Type approval Certificate was issued for BCM94322MC, Broadcom 802.ag/draft802.11n WLAN PCI-E Minicard to Broadcom Corporation under the Type Approval Procedure formulated by the NTA.
2.5.   Frequency spectrum in CDMA 800 MHz band is assigned to United Telecom Limited (UTL) for the Deployment of Basic/limited mobility service in different parts of the state including the rural areas.
2.6.   Under the convenorship of Mr. Nirmal Pradhanang (consultant) a Sub-Committee comprising of Mr. Ambar Sthapit , Deputy Director (Engineering) and Mr. Min Prasad Aryal, Assistant Director (Engineering) is formulated in order to recommend the future actions to be taken including the allocation, assignment, reforming (revision) of spectrum in 450 MHz, 900 MHz, 1800 MHz, 2100 MHz band for different cellular applications.   It is expected that the committee would submit the report as per the specified ToR.
2.7.   A RTDF Mobilization Committee has been formed in order to accomplish the assignments specified in the RDTF Disbursement Procedure By-Law and By-Law regarding the selection of the Operators. The members of the committee are: Mr. Bhesh Raj Kandel (Coordinator), Mr. Reg Bahadur Bhandari (Member), Mr. Ramesh Adhikari (Member) and Mr. Min Prasad Aryal (Secretary). The committee has started its work as per the specified duties and responsibilities.
2.8.   The progress report for the month of Falgun of the Policy/Program and Implementation plan for the fiscal year 064/065 of the Authority has been sent to the Ministry of Information and Communication. As per the report the number of unserved VDCs is 703.
2.9.   Expression of Interest (EoI) evaluation report on the Capacity Building for NTA has been submitted.
2.10.                    Terms of Reference (ToR) have been developed for the South Telecommunications Regulator’s Council’s (SATRC) working group on VoIP regulation.

3.    Authority's Major Decisions in the month of Falgun 2064 (13 February - 13 March, 2008):

3.1.1.      The Nepal Telecommunications Authority’s (working procedure related) by-law first amendment 2064 has been approved.
3.1.2.      NTA member Mr. Tulasi Bhatta has been appointed to work for Judicial Committee as per the clause 3(2) of the Nepal Telecommunications Authority’s (working procedure related) by-law.
3.1.3.      Mr. Kailash Prasad Neupane, Deputy Director, NTA has been appointed to work as registrar as per the clause 3 ka (1) of the Nepal Telecommunications Authority’s (working procedure related) by-law.
3.1.4.     In relation to the Internet Telephony tariff published prior to NTA’s approval by M/s Worldlink Communications Pvt. Ltd., decision has been made as per the recommendation from the legal section.
3.1.5.     As M/s. Nepal Satellite Telecom Pvt. Ltd. has furnished all the details in the reply in response to the Letter of Intent (LoI) issued by the Authority, authority has decided to award Basic Telecommunication Service license to it.
3.1.6.     As United Telecom Limited has requested a frequency band in the CDMA–800 Band, it has been decided to award 2 Channel [2 X (2 X 1.25MHz)] in that band for now.
3.1.7.     The decision of the management to award 883-888 MHz Paired with 928-933 MHz Frequency to run service using MF-TDMA system to M/s STM Telecom Sanchar Pvt. Ltd. dated 2064/7/20 has been approved.
3.1.8.     The management has been directed to submit the annual program and budget for the next fiscal year by the end of Chaitra, 2064 as per the three year interim plan of the Telecommunication sector.
3.1.9.     With Mr. Kumar Prasad Sharma, Deputy Director, NTA as the coordinator, Mr. Ambar Sthapit, Deputy Director, NTA and Mr. Deeepesh Acharya, Deputy Director, NTA has been directed to submit the first phase of report within three months after completing work as per the rule 17 of the Telecommunication Act 2053 B.S.
3.1.10.A Sub-committee has been formed under the coordination of Mr. Nirmal Pradhananga with Mr. Ambar Sthapit, Deputy Director, NTA and Mr. Min Prasad Aryal, Assistant Director, NTA to submit a report within 30 days by formulating Channel Plan, Frequency Plan taking into consideration the current allocation and assignment in the Cellular applications of 450, 800, 900, 1800, 1900 / 2100 MHz Band CDMA, 3G (WCDMA), GSM, EGSM, MF-TDMA technologies and International best practices.
3.1.11.Recommendation has been sent to the Ministry of Information and Communication Radio Frequency Policy Determination Committee to make provision for the testing of Microwave equipment in the 7.5 GHz band for a maximum period of one year and the operator should send the test report to the Authority after the completion of the test.
3.1.12.Tariff of IP Telephony of M/s Broadlink Networks and Communications Pvt. Ltd. has been approved.
3.1.13.Tariff of IP Telephony of M/s Infocom Pvt. Ltd. has been approved.
3.1.14.As M/s. M/S Lal Sahu Distribution Pvt. Ltd. Singapore, Gilat Satellite Networks Ltd. Israel & Square Networks Pvt. Ltd. Nepal have furnished all the details in the reply in response to the Letter of Intent (LoI) issued by the Authority, authority has decided to award Rural Telecommunications Service (RTS) license in the unserved VDC's of Far West, Mid West, Western & Central Development Region of Nepal after the proposed M/S Smart Telecom Pvt. Ltd of the consortium is duly registered.
3.1.15.Tariff of IP Telephony of M/s Worldlink Communications Pvt. Ltd. has been approved.

3.1.19.Expert Mr. Ramesh Adhikary has been appointed to the post of expert member in the Rural Telecom Development Fund disbursement committee for a period of two years.
3.1.20.As the Quality of Mobile (QoS) service provided by M/s Spice Nepal Pvt. Ltd. and M/s Nepal Doorsanchar Company Ltd. is not found to be fulfilling the parameters mentioned in the license after the preliminary study conducted by the Authority and the deep public dissatisfaction over the quality of service of mobile in recent days, the meeting of the authority has decided to issue directive to the operators to submit the details of the QoS they are providing at present and if they are against the prescribed QoS, at what time they will be able to provide service as per the prescribed QoS by one month.
3.1.21.The draft license to be issued to the “Network Service” operators has been approved.
3.1.22.As per the notice published in the national gazette on 10 Mangsir 2064 B.S. to convert the license of VSAT Network Service Provider and Local Data Network to Network Service, it has been decided to issue Network Service license to those operators who have been issued VSAT NSP License and Local Data Network Service License prior to 18 Ashwin, 2064 B.S.
3.1.23.The Authority has decided to award Network Service License to M/s Subisu Cablenet Pvt. Ltd. as per rule 24(2) of Telecommunication Act 2053 B.S. and approve the attached Tariff of the said service.
3.1.24.Tariff of IP Telephony of M/s AceCom Pvt. Ltd. has been approved.
3.1.25.As requested by the M/s Spice Nepal Pvt. Ltd. to add airtime charge of Rs. 1.99 on the tariff approved earlier for International calls from Prepaid Mobile, the Authority has decided to do so as per the request.
