1.    Introduction:

            Nepal Telecommunications Authority was established in March 4, 1998 as an autonomous regulatory body within the framework of the Telecommunication Act 1997 A.D. and Telecommunication Regulation 1997 A.D.

As per the section 13 of the Telecommunications Act 2053 B.S. (1997 A.D.) the functions and duties of the Authority are as follows:

(a) To provide suggestions to Government of Nepal on the policy, plan and program to be adopted by Government of Nepal for the development of the Telecommunications Service.
(b) To make the Telecommunications Service reliable and easily available to the public.
(c) To make necessary arrangement to avail basic Telecommunications Service and facilities in all rural and urban areas throughout Nepal.
(d) To involve the national and foreign private sector investors in the operation of the Telecommunications Service.
(e) To make arrangement for the coordination and healthy competition among the persons providing Telecommunications Service and facilities, so as to provide such service and facilities to all public in general.
(f) To prescribe, fix and approve the standard and quality standard of the plant and equipment relating to the Telecommunications and the Telecommunications Service.
(g) To regularize and systematize Telecommunications Service
(h) To grant License to operate the Telecommunications service.
(i)  To approve and regularize the fees to be collected by a person having obtained License for providing the Telecommunications Service.
(j) To perform the functions relating to the frequency in accordance with the policy determined by the Radio Frequency Policy Determination Committee.
(k) To carry out or cause to carry out the research about the development and use of new technology in the field of Telecommunications.
(l) To cause to develop the skilled manpower for the Telecommunications Sector.
(m) To develop and extend or cause to develop and extended the Telecommunications Service in such a way that it protects the rights and interests of the consumers.
(n) To develop or cause to develops Nepal as an International Transit for Telecommunications.
(o) To carry out necessary and appropriate functions for the development and promotion of the Telecommunications Service.

2.    NTA activities during the month of Baisakh, 2065 (13 April – 13  May, 2008):

2.1.            Press Meet has been arranged to apprise the general public about the newly implemented Interconnection Guidelines 2065 (2008), decision regarding ADSL service and local dialling issue in Internet Service.

2.2.            The team comprising of Deputy Directors Mr. Kumar Prasad Sharma, Mr. Ambar Sthapit, Mr. Deepesh Acharya and Assistant Director Mr. Udaya Raj Regmi visited Butwal, Bhairahawa, Pokhara and Chitwan to find out the possible interference problem in UTL’s network and verification of the equipment installed at UTL’s base station at those places as per the record of NTA.

2.3.            Two Limited Mobility Service licenses have been granted to UTL to operate within Morang and Sunasari Districts respectively.

2.4.            World Vision International Nepal has been granted Rural VSAT user License to use at Chandannath of Jumla district.

3.    Authority's Major Decisions in the month of Baisakh 2065 (13 April – 13  May, 2008):

3.1.            The decision has been taken to issue VSAT Service User license to following institutions as per the section 24(2) of Telecommunications Act 2053 B.S.

3.2.            The Internet (including Email) Service License to M/s Beyond Himalaya Broadband Internet Service Pvt. Ltd. and M/s Dolpo Batabaran Samrakshan Kendra has been approved alongwith the below tariff for the said service.

3.2.1.     Beyond Himalaya Broadband Internet Service Pvt. Ltd.
16 Kbps: Rs. 1000 per month
32 Kbps: Rs. 1800 per month
64 Kbps: Rs. 2500 per month
3.2.2.     Dolpo Batabaran Samrakshan Kendra
16 Kbps: Rs. 1000 per month
32 Kbps: Rs. 1800 per month
64 Kbps: Rs. 2500 per month

3.3.            The decision has been taken on the application filed by M/s Websurfer Communication Pvt. Ltd. and others against the M/s Nepal Doorsanchar Company Limited for getting equal treatment among the operators.

3.4.            The decision has been taken on the application filed by M/s Worldlink Communications Pvt. Ltd. others against the M/s Nepal Doorsanchar Company Limited for stopping discriminatory behaviour among the operators.

3.5.            Taking under consideration the decision taken by the NTA in clause 3.4 above, the following tariff for ADSL service has been approved  as per the section 42(2) of the Telecommunication Act, 2053 B.S.

3.6.            The existing Interconnection Guidelines has been replaced by the new Interconnection Guidelines, 2065 (2008) (Document No. GI065.01). The revised Interconnection Guidelines will be enforced from 01 May, 2008.

3.7.            As per the rule 12 of the Telecommunication Regulation 2054 B.S. (1997 A. D.) the license (License No. GMPCS02)  of M/s AVCO International Pvt. Ltd. has been renewed for a period of five years (till 2069/12/19 B.S.).

3.8.            As per the rule 12 of the Telecommunication Regulation 2054 B.S. (1997 A. D.) the license (License No. V. G. 6-39 and V. G. 6-40) of M/s Standard Chartered Bank Ltd. has been renewed for a period of five years (till 2070/02/05 B.S.).

3.9.            On the application filed by the licensee of RTS – 2 for changing the VDC list, the management has been directed to resubmit the proposal with the overall situation of the VDCs with access to telephone after the telephone access has been provided to 273 Mandatory VDCs of Mid-Western Development Region and 398 Mandatory VDCs under RTS-2 out of 3915 VDCs of Nepal.

3.10.        As per the rule 12 of the Telecommunication Regulation 2054 B.S. (1997 A. D.) the license of M/s Websurfer Nepal Communications System Pvt. Ltd. has been renewed for a period of five years (till 2070/01/21 B.S.).

3.11.        The following sub-committees have been formed which will submit necessary suggestions to implement the decisions of NTA regarding ADSL service and Accounting Separation

3.12.        The evaluation committee comprising the following officers of NTA has been formed to evaluate the submitted proposals (Technical and Financial) for the Capacity Building for NTA and recommend the Authority to select the right institution.

3.13.        The Internet (including Email) Service License to M/s Information Technology Center, Nepal has been approved along with the below tariff for the said service as per the section 24(2) of the Telecommunication Act 2053 B.S.

3.14.        The VSAT Service User License to M/s Information Technology Center, Nepal has been approved as per the section 24(2) of the Telecommunication Act 2053 B.S.

3.15.        Decisions related to Frequency:

3.15.1.The following frequencies have been assigned to M/s Nepal Satelllite Telecom Pvt. Ltd. to provide Basic Telecommunication Services.

1.      A total of 2X5 MHz Frequency Bandwidth in CDMA 800 MHz Band from 835-840 MHz paired with 880-885 MHz including guard band.

2.      A total of 2X4.4 MHz Frequency Bandwidth in GSM 900 MHz Band from 910.6-915 MHz paired with 955.6-960 MHz including guard band.

3.      A total of 2X9 MHz Frequency Bandwidth in GSM 1800 MHz Band from 1744-1753 MHz paired with 1839-1848 MHz including guard band.

4.      With Regard to Microwave Frequency, the process will be forwarded once the requested descriptive detailed Network plan and Frequency plan is obtained.

3.15.2. The frequency range 824-835 MHz paired with 869-880 assigned to Nepal Doorsanchar Company Limited in the CDMA 800 band has been reviewed and reassigned as 827-835 MHz paired with 872-880 MHz including guard band.

3.15.3. In line with the previously assigned two channels in the CDMA-800 MHz Band, the United Telecom Limited has been allowed to use two channels (per channel 2X1.25 MHz Bandwidth) in 824-827 MHz paired with 869-872 MHz bandwidth.

3.15.4.The frequency range 883-888 MHz paired with 928-933 MHz (2X5 MHz bandwidth) assigned to M/s STM Telecom Sanchar Pvt. Ltd. has been reviewed and reassigned a total of 2X2.4 MHz as 887.6-890 MHz paired with 932.6-935 MHz including guard band.

3.15.5.As per the request from M/s Nepal Satellite Telecom Pvt. Ltd., it has been decided to send the attached letter to GSM Association.
